Badass Lawyer of the Week: David Newdorf
[Ginny LaRoe] A San Francisco lawyer brokered a hell of a deal Thursday night. Leaving his downtown office, business litigator David Newdorf of Newdorf Legal fell prey to a band of cell phone thieves. But he proved quick on his feet. Newdorf was headed to the Ferry Building from Montgomery St...

D.C. Judge Rebukes Birther Lawyer for Filing Errors
U.S. District Chief Judge Royce Lamberth issued an order (PDF) yesterday scolding Orly Taitz, a lawyer and "birther" activist, for "wasting the Court's time" by failing to redact social security number information in court papers in violation of federal rules. "Plaintiff is either toying with the...
Sadly, this dentist who added law to her CV for reasons we may speculate on, has also driven away most of her patients. Yes, I do have some personal knowledge of this, but who knows what she reads so I will say no more.
She is probably very bright--and she was much more personable when I watched the video of her on The Colbert Report than I would have guessed--but maybe growing up in Russia messed with her mind. As a grandchild of Russian Jewish immigrants I cringe when she starts up.

Real Judge Agrees with Judge Carton in 'Google Map Slave' Case
Just over a year ago, Judge Carton considered the case of Lauren Rosenberg, who sued Google after she was hit by a car while following walking directions provided by Google Maps on her cell phone. In an ongoing series of posts here at LBW called Judge Carton Rules, a fake judge issues rulings to...
I could make peace with the snakes, and be happy to live there--but the attorney jokes would get old!
Family's Purchase of 'Snake House' Leads to Foreclosure, Bankruptcy and Post-Traumatic Stress Disorder
And now for a story that nearly caused my snake-hating wife to have a breakdown. The Associated Press reported earlier this week on the plight of the Sessions family, who in 2009 purchased a five-bedroom house in the Idaho countryside for about $180,000. They were required to sign a document at ...
The opinion if the court made it crystal clear the evidence was used FROM THE OUTSET--from the opening statement--to bring "satanic influences" in as the motive. It was explicit.
What I do not understand is why there was no mention of gunpowder testing of the defendant--only of the victim. (The victim had gunpowder residue.) If this teenager fired the gun, she would have had gunpowder residue.
If she had none..... (and why would it not have been in evidence if she did?...) then she probably didn't fire the dam* gun!
Georgia SC got it right on this one!
Use of Irrelevant Evidence of 'Goth' Lifestyle Leads to Reversal of Murder Conviction
Via Siouxsie Law I came across an interesting recent opinion of the Supreme Court of Georgia that reversed a murder conviction because the trial court allowed the prosecution to introduce "irrelevant and highly prejudicial character evidence" about a teenage defendant's "goth" lifestyle. The cou...
Looks legit to me: the unique location of the original work should not make any difference. Permission might have been granted if sought!
'Hangover II' Injunction Denied, but Tattoo Dispute Goes Forward
On Thursday, the blockbuster sequel "The Hangover Part II" opened in theaters around the world as planned, despite the efforts of artist Victor Whitmill. As discussed here previously, Whitmill filed a copyright infringement lawsuit against Warner Bros. alleging that he owns the rights to the wel...

Website Unveils Foolproof Age Verification Test
Many websites require users to verify their age before they can use the site or to register. In order to have a Facebook account, for example, users must be thirteen years of age or older. However, as the parents of many Facebook-using children can attest, it is no real challenge for underage pe...

U.S. Secret Service Becomes Latest Victim of a 'Wrong Pipe' Tweet
As I noted last month, law firms getting more active on Twitter need to avoid three main types of "self-destructive" tweets. First on the list was the increasingly common "wrong pipe" tweet, which occurs when the person responsible for tweeting for a company or law firm accidentally tweets from ...
"Jane"- I made no statement as to the correct amount of damages in any given case.
My mother used to steal from AT&T--I forget how she would get around paying LD charges to call me when I was in college back before moveable type (joke). That was wrong too.
Sorry-- it is wrong. I am no supported of the porn industry--but they have lost TONS of money due to piracy.
Good luck in arriving at some just result.
Porn Industry May Play the 'Shame Card' in Litigation, Part II
As I wrote here less than two weeks ago, following a secret meeting in Tucson last month, the porn industry appeared to be on the verge of unleashing a litigation storm against piracy that would make use of an unusual weapon: the "Shame Card." As one industry executive stated last month, "It see...
I note you were responding in kind as well.
Lawyer Pulls No Punches in Scathing Response to Judge's 'Half-Baked' Order to Show Cause
Via the South Florida Lawyers blog I came upon an extraordinarily misguided bold Response to a bankruptcy judge's Order to Show Cause filed by a Florida lawyer named Kevin C. Gleason. I don't completely understand the underlying ruling, but I don't think I really need to in order to get the poin...
Mr Gleason: except for the use of the word "you" I felt your words --the ones I read here--were well said. I hope you win!

Police Use Data Shared by TomTom GPS Users to Set Targeted Speed Traps
Companies that ask you to allow them to collect information about your use of their product may have good intentions, but sometimes purchasers of that information may have other plans. For example, when you sign up for the TomTom GPS device service, the company asks you if it is OK if they collec...

Punk Band Wins Legal Skirmish, Lambastes Plaintiff and Opposing Counsel in Animated Video
In the year 2011, one of the new things lawyers apparently need to worry about is that the opposing party will create an animated video celebrating a legal victory and mercilessly mocking the losing lawyers. Fulbright & Jaworski finds itself as the "mockee" in such a video (below) following a ju...

The Law Firm and Corporate 'Anthem' Collection: Build It for the Children
Above the Law wrote today about law firm Nixon Peabody, and mischievously included a link to a firm anthem (for lack of a better word) that the law firm clearly put some effort into creating in 2007 before apparently realizing that it was going to haunt them forever. You can read the ATL account...

One More Consequence of Being a 'Nonessential' Government Employee: Surrender Your BlackBerry in a Shutdown
The Washington Post reports that an unexpected casualty of any government shutdown may be the BlackBerrys and other PDAs of "nonessential" government workers. Under the Anti-Deficiency Act, it is illegal for nonessential federal employees to voluntarily work during a shutdown. According to the P...

Defining 'Reasonable Doubt'? Appellate Court Tells Trial Courts to 'Let It Be'
At the California Appellate Report blog, Shaun Martin points to the recent case of People v. Moore as the latest example of why the appellate courts really, really wish the trial courts would not try to explain the concept of "beyond a reasonable doubt" to jurors. Over and over, California appel...

Does Pot Have a Shot at Being Legalized in the U.S.?
Rhode Island, which legalized medical marijuana in 2006, is now wrestling with the next big question on that front: whether to become the first state in the U.S. to make pot legal for recreational use as well. The motive? Money. The Associated Press reports that, if the proposal goes into law, w...

Calendar Snafu Leads to Default Entered Against Wachovia in Securities Case
The South Florida Lawyers blog reports that the auction rate securities action filed against Wachovia in federal court in Florida is, well, going poorly for the defendant at the moment. How poorly? On March 9, SFL says, Judge James Lawrence King entered -- sua sponte -- a default against Wachovi...
I am not sure if the comment "Plaintiff's lawyer absolutely correct. We're paid to win, at whatever cost, not to be a nice guy. Leave that to those Legal 'Rebels'" ;-) " was meant as a slam to these litigators or the Legal Rebels". but I assure you we NEED these rebels. We also need HONEST litigators. But as someone said to a man with only a hammer everything looks like a nail. Some of us, including J. Kim Wright and lil' ol me, think we need a few more tools.

I concur. But everything that is being done in the name of "national security" is frightening. This is just one thing that really affects people. The rest, as we all know, is hidden and unaddressed. Still I am a glad he did this
Airline Passenger Sues TSA for False Imprisonment
Since the Transportation Security Administration began screening airline passengers with body scans and pat-downs, people have chosen various ways to express their distaste for the measures. One such person is Aaron Tobey, who, when going through security at Richmond International Airport on Dec...
I do believe that's what's known as "statutory construction."
How the Tea party types hate "activist judges" who change the law!!! Let them change the statute if they want to make it applicable to this dude and whoever else they entrap.
Pimp Law: Are You Offering Pimp Services if the Woman Is Already 'in the Game'?
There is such a thing as California pimp law, and on March 8 the California Supreme Court will hear argument in a case that will help define it. The Associated Press reports that in 2007, Jomo Zambia was in his car at a "notorious intersection" in the San Fernando Valley known for its prostitute...
I have heard of desperate substitute teachers using anything to get through class... but "Brokeback Mountain"?
Friday's Three Burning Legal Questions
Here are today's three burning legal questions, along with the answers provided by the blogosphere. 1) Question: Hooray! The substitute teacher in my 7th grade math class just told us we get to watch a movie today! Wait, what did that cowboy in the movie mean when he told the other cowboy, "I w...

Reminder: When Committing a Crime, Don't Call 911 for Legal Advice
Robert Michelson learned the hard way that you shouldn't call 911 for free legal advice on growing marijuana. After the 21 year-old Connecticut man asked a dispatcher how much trouble growing one plant could bring him, Farmington police quickly tracked the call to his home, where he was arrested...
That was in the early 90s if memory serves. I think only DUI attorneys and bail bonds get business there...
How's That Ad Campaign Doing? -- Search Me!
Ever have one of those weeks when a lot of things you take for granted begin to change on you? Take last week, for example. Under legislation that came up before San Francisco's Board of Supervisors (pdf), that city -- popularly derided for taking away innocent tykes' fast-food toys and prying p...
