I do not agree Firstly, it is not a defence to say I made a mistake - if this were the case the magistrates of this country would not sentence anyone as the defendants would just say I made a mistake, sloppy book-keeping etc. etc. Secondly, I think this particular fraud was premeditated - he had no statement from the building society detailing the mortgage repayments so he just sent in his bank statements showing outgoings to a building society - it just so happens the mortgage repayments he had hitherto made was exactly the same amount as his savings deposits Guilty as charged I say
