Heh. You've really hit the nail on the head with your comment about how that opening statement of the issue can sometimes be a tease (i.e., when the court never reaches it).
Very entertaining presentation of the appellate issues. Shame on me for not beating you to the punch! I'm too swamped to write about it in detail at The California Blog of Appeal, but maybe I'll have more to add there after the weekend.
The cost-shifting issue also strikes me as one in the "I can't believe they've never decided that before" category.
