The Lee County Property Appraiser Ken Wilkinson said Wednesday that homestead exemptions filed by Republican U.S. Senate candidate Connie Mack IV and his wife are legal.
Property records show Mack and his wife, Mary Bono Mack, each has an exemption — he in Lee County and she in Riverside County, Calif.
A Tampa attorney said the Macks could be violating Florida law because they should be allowed only one exemption.
Not so, Wilkinson said. He said a 1963 Florida Supreme Court ruling, which had its roots in a Lee County case, likely means Mack is in the clear.
“There is no law that prohibits a husband and wife, each maintaining a separate residence, and being otherwise qualified, from each claiming a homestead exemption,” said John J. Renner, general counsel for Wilkinson’s office.
