The problem with the unemployment idea is that you generally have to get a signature for turning it in, or it doesn't count. I can't see this behavior leading to ANYONE giving him a signature.

When I worked at a certain major video game chain, before they bought out their major competitor (that still is the name of their Canadian stores), we would price-match the other store, which was in the same mall as us (actually, down a handful of stores and around the corner, we were that close). The catch was, we had to confirm it, AND it had to be in stock. I'm sure they knew it was us when we called asking for the price and availability of certain games. And I'm sure they called us for the same thing, too.

Proper response (which I do all the time, both with in-store and phone customers): I'm sorry, we don't have any room for them out right now, so they're still in the back. Unfortunately, our back room is hard to pinpoint specific items in, and we're a bit tight on staff at the moment. Can I get your name and phone number, and when someone gets a chance to look for them, we can give you a call?

From Chick-named-Craft-Store, I feel your pain. "Here's another box of [brand] patterns." "But there is absolutely no room in the drawers for more [brand] patterns. Can I keep them in a box instead?" "They have to be in an inventory box." "But inventory boxes don't fit patterns very well." "We'll have to figure something out, then." (for the record, the thread stands are next to the patterns, have drawers for overstock, and had an empty drawer!)

Wouldn't she have had to see the ID anyway? Because people can make up birthdays, if you're just requiring them to tell you. I thought, in those cases, you were supposed to see their ID and copy the birthday from it?

So I see that being an asshole is a requirement of the job to be a Subway franchise owner. I wish I had've kept records when I worked at one, so I could've sued for the unpaid wages due to illegal break and meal period policies.

They could have thought that by "hold", you meant something like layaway, in which they'd have to pay extra. In any case, if someone declines putting something on hold at my work, especially if it's something we can't get back in or get from another store, I always caution them that I can't guarantee it will be there when they return. Just extra insurance in case they make a fuss, I can remind them that I told them I couldn't guarantee it.

My mom, now that I've read her this, has more comments to chime in: 1) Not sure on CA law, but in WA, if they were unloading in the parking lot, they wouldn't be covered by L&I, because they're outside the store. 2) Also not sure on if this is CA/WA law difference, or Dude/Chick craft store difference, but Mom also says that they're not allowed to step onto the truck. The one time they had a driver who refused to unload, they had to stand around waiting until the driver could round up some day labor to do it. 3) As soon as the kerfluffle started, Mom also said that their MOD (Mom on Duty, realistically) would have been on the phone with the distro center demanding someone who CAN drive back into the loading bay. 4) Given that truckers regularly cross state lines, license requirements should be the same in CA/WA. Mom also says that it's not just part of the job that the driver needs to know how to back into the bay, but it's part of the test to get your license! He can't have the license without knowing how to!

As someone who works at ChickNamedCraftStore, and whose mother also works there, and used to be on truck duty, you have my full sympathies, and I hope that that driver gets ripped a new one by his bosses after yours are done with them.
