One further comment: The Appeals court ruled that since they allege a "procedural error" in our case, then they ruled against us on a Rule 60(b) motion for relief-even though we were correct and our home was essentially stolen from us. The circular logic here is eye-popping: Rule 60(b) is PRECISELY to allow the court to overturn a ruling that may have had procedural errors, but JUSTICE WAS NOT ACCOMPLISHED. Wow.

Mr. James; I am very grateful that you took the time to comment. It has been a painful experience. The most painful part is the indisputable evidence that our justice system is broken. We literally were denied our right to rescind, because we did it properly, and that is, at it's most basic: manifest injustice. Beryl; Thank you again for your kind words. I am compelled to comment that I do lean on Him for strength and guidance, as many do. I DO NOT ask him for help with regard to my case. I ask him for the personal strength to fight my battles and access my rights. I also feel STRONGLY that all people, regardless of whether or not they are of any faith or not, have a right to expect justice (I know you do too). Surviving this horrific chapter in our lives has not been easy. It is not easy to have your opponents stand in a courtroom and accuse you of actions that NEVER happened, and to characterize you as the very type of citizen you abhor, like a person who intentionally would default on a promise of any kind. We have strong moral integrity, and that is the most hurtful thing they can do. They seem to know this. This is what I pray about. To suppress the ugly hatred that tries to infect me. I fight that more than anything. I DO believe that some people are very miserable. You would have to be a very low person indeed to get up every morning and go to work with INTENTION to harm people in this way. There are people that are doing this, and I don't understand it, but then, I am glad I don't understand it. Thanks again.

Hello Stanley; I am so very sorry to hear of your nightmare. I can completely imagine. Well, I agree with you that the people are starting to act out in various ways. I think it has taken a long time for people to really truly have the trust blown and truly understand the actual corruption that is taking place. There are still those that think that nothing is going on and millions of people all decided to quit paying their mortgage and abandon their homes. Many of us have been "waiting for change" I guess assuming that eventually the regulators would "do something". Well, I think they have sufficiently proven that they have no intention of doing anything (for a whole list of terrible reasons). One thing I do know, is we must speak up. Hello Deborah; I am sorry for your struggle, and I understand. WE MUST COMMUNICATE BETTER. There is an attitude in our courts of "this is just another foreclosure... NEXT!" They are not adjudicating, they are PROCESSING cases. It's a horrific shame. If they would start adjudicating, the case loads would DECREASE because these THUGS (I blame the foreclosure trustees because they are the gate through which all non-judicial foreclosures must pass). If they did what they were legally required to do, then the "lenders" would quit crushing the masses. YES there are still foreclosures that are warranted, OF COURSE. I am not "anti-foreclosure". I am anti corrupt trustees. THEY ALONE are the main reason for this.

Hello B wRight; I do not know of an attorney that is taking new Rescission cases, but I will send out some inquiries and if I find anything I will get back to you. Unfortunately, because of the nature of this type of litigation, simply finding an attorney is a big part of the problem. There aren't enough of them that truly understand TILA Rescission, and of those, most are beyond capacity to take on more new clients. GOOD LUCK to you in this effort. DO keep us posted!
