IS THIS A BIG JOKE AFTER ALL? I am fascinated with the concept of the United States. It seems to me that it takes a particular form of silliness to accept its basic premises. The lack of reality is not serious enough to be considered conventional madness. In a certain sense the Liberals are more consistent and honest in this matter than are the Conservatives. The Liberals work to destroy the system that does not work. The Conservatives continue to praise and to “protect” something that does not exist. Consider the issue of abortion. Recently a law (at least) restricting abortion in some state was declared invalid by some court. It is my impression that this happens on a regular basis. It is all only a farce. The useless passing of laws makes “right to life” people happy. Some politicians have probably fulfilled a promise. And the employees of Murder Incorporated (Planned Parenthood) know that the inevitable (and speedy) court decision will allow the executions to continue. It is my own judgment that abortion is a permanent part of both culture and law in the Western World. However, consider the reasoning. The court decided that killing children was a “well established” principle, i.e. a legal right. This could be understood as adhering to the principle of stare decisis, or the doctrine of legal precedent. This means that once a proper court decides on an issue all other courts are required to decide the same way. The principle behind this rule is that… Well, perhaps it is based upon the ancient rules of the Persian Empire. According to ancient legend, the laws of the Persians changed not. What one emperor said bound successive emperors. I guess that this is what the judge referred to. It could not have been an American legal principle. American abortion laws were overturned by Supreme Court rulings. The (in)justices found a new right that no one had seen for long over one hundred years. In fact abortion had been illegal in many states. That is, its unlawful status had been established by legal principle. And so the Supreme Court adhered to the legal principle of… of “anything goes!” The entire series of anti anti-abortion decisions were indirect violation of already decided legal precedent. To adhere to ANY already decided legal case is to prevent new laws from being passed (if the establishment opposes them). Everyone knows this. Legal principles are discovered, recovered, renounced and ignored all the time. Various sides will base a case, or decision, upon precedent, if the precedents support their positions. But, despite serious expressions, and serous sounding pronouncements, they really are of little or no influence. As I declared above, it is all a farce. The founding fathers may not be rolling over in their graves. However, they probably are laughing. Maybe it all really is a joke. Continue reading
